Terms of Use

1. Acceptance

These Terms form an agreement between you and ProVisual (“we”, “us”) governing your use of the ProVisual app and its features.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the app. By using it, you confirm you meet this requirement.

3. The service

ProVisual lets you create images with artificial intelligence from photos you provide and the templates, effects and tools in the app. Results are generated automatically and may vary in quality or accuracy.

4. Accounts

The app creates an anonymous account so we can store your token balance. You may optionally Sign in with Apple to keep your tokens and history across devices. You are responsible for activity under your account. You can delete your account and associated data in the app or by emailing us.

5. Tokens, subscriptions & payments

• Tokens. Generations consume tokens (3 tokens = 1 photo). Tokens are a limited license to use the generation features, have no monetary value, cannot be exchanged for cash, and are non-refundable except where required by law. If a generation fails, the spent tokens are returned to your balance.
• PRO subscription. PRO is an auto-renewable subscription. Payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• Manage & cancel. You can manage or cancel your subscription any time in your device’s App Store account settings. Prices are shown in the app before purchase and may vary by region.
• Processing & refunds. Purchases are processed by Apple; refunds are handled by Apple under its policies. Apple’s standard EULA also applies to purchases made through the App Store.

6. Acceptable use

You agree not to:

• Upload photos of other people without their consent;
• Create content that is illegal, pornographic, hateful, harassing or otherwise offensive;
• Infringe anyone’s intellectual-property or privacy rights;
• Impersonate others or create misleading “deepfakes”;
• Use the app commercially without our permission, or attempt to hack, overload or disrupt the service.

7. Content & rights

You keep the rights to the photos you upload. You grant us a limited license to process them solely to provide the generation service. By uploading, you confirm you have the right to use those photos. Generated images are provided for your personal, non-commercial use, and you are responsible for how you use them. The app’s templates, effects, design and branding belong to ProVisual.

8. AI-generated content disclaimer

Outputs are produced by AI and may be inaccurate, unexpected or not as intended. You must not use the app to create unlawful, deceptive or harmful imagery, or to misrepresent real people.

9. Disclaimers & limitation of liability

The app is provided “as is” and “as available”, without warranties of any kind. We do not guarantee the accuracy or quality of generations, uninterrupted operation, or that results will meet your expectations. To the maximum extent permitted by law, we are not liable for any indirect or consequential damages, or any loss arising from your use of the app.

10. Termination

We may suspend or terminate access if you violate these Terms or use the app in a way that harms other users or the service.

11. Changes to these Terms

We may update these Terms from time to time. We will revise the “Last updated” date above, and continued use of the app after changes means you accept the updated Terms.

12. Governing law

These Terms are governed by the applicable laws of your country of residence to the extent required by local consumer-protection law; otherwise by the laws of the developer’s place of residence, without regard to conflict-of-law rules.
